2. The petitioner seeks regular bail in connection with Bikram P.S. Case No. 23/2023 / special case no. 30/2023 registered for the offences under Section 354 of the Indian Penal Code and Sections 8/12 of the POCSO Act.
3. The prosecution story in short is that the informantPriti Devi gave a written application alleging therein that her 6 year old daughter while on her way to shop was molested by the petitioner and he had also tried to press her neck and nose.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this

Even from perusal of the FIR it appears that no offence as such, is made out against the petitioner. Learned counsel further points out that there is an allegation of causing injury to the victim girl, however, there was no medical examination done as the victim girl refused to undergo any such examination. It is lastly submitted that the petitioner has got clean antecedent and he is languishing in custody since 02.09.2024.
5. Learned counsel for the State has opposed the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and taking into account that the petitioner has no criminal antecedent and he is in custody since 02.09.2024, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-VII- cum- Special Judge, POCSO, Patna in connection with Bikram P.S.
