JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 04-02-2019 The appellant seeks pre arrest bail in connection with Teghra P.S. Case No. 53/18, registered for offences punishable under Sections 406/420 of the Indian Penal Code and Section 3 (r)(s) of SC/ST Act.

Allegation against the appellant is that he got a tractor purchased in the name of informant on loan from Mahendra Finance Co. and took the said vehicle in his own possession and assured the informant that he will pay the installments of loan, however, a notice was received by the informant from Mahendra Finance Co. for demand of loan and when the informant went to enquire the matter from the appellant and for return of his vehicle, he did not return the vehicle and also abused him by caste name. It has been submitted on behalf of the appellant that he has falsely been implicated in this case and in fact the appellant has

Patna High Court CR. APP (SJ) No.64 of 2019 dt.04-02-2019 2/2 helped the informant financially to purchase the vehicle and when the appellant demanded his money back, this present false and concocted case has been lodged with a view to swallow the money of appellant.

Having heard both sides, considering the facts and circumstances of the case, let the appellant, above named, in the event of his arrest or surrender before the Court below, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge SC/ST Act, Begusarai, in connection with Teghra P.S. Case No. 53/18, subject to the conditions laid down under Sectin 438 (2) of Cr.P.C. Accordingly, this appeal is allowed and impugned order is set aside.
