JUSTICE SHIVAJI PANDEY ORAL ORDER 25-01-2019 Learned counsel for the petitioners submits that petitioner no.1 has already been arrested and as such, he does not want to press this bail application on behalf of petitioner no.1.

In such view of the matter, this bail application is dismissed as against petitioner no.1.

In this case, the petitioner no.2 is seeking anticipatory bail in connection with Navkothi P.S. Case No. 43 of 2018, registered for the offence punishable under Sections 341, 323, 307, 385, 504 and 506/34 of the Indian Penal Code. Allegation has been made against the petitioner that he has demanded Rs.50,000/- from the informant and also assaulted him with the butt of the pistol.

Patna High Court Cr.Misc. No.80794 of 2018(2) dt.25-01-2019 2/2 The petitioner no.2 has a criminal antecedent. Hence, this Court is not inclined to grant bail to the petitioner no.2. Accordingly, the prayer for bail is rejected. However, if the petitioner no.2 surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
