JUSTICE SANJAY PRIYA ORAL ORDER 6/ 03-07-2019 Heard learned counsel for the petitioners and learned APP for the State as well as counsel for the Informant. Petitioners seek bail in Lauriya P.S. Case No.181 of 2018 instituted for the offence under Section(s) 466, 467, 468, 471, 474, 420, 120-B/34 Indian Penal Code pending in the Court of the Chief Judicial Magistrate, West Champaran at Bettiah.

Counsel for the informant submits that there are other cases also pending against the petitioners, but the same has been suppressed in para 3 of the bail application. This fact has been brought to the notice of the Court on 24.04.2019 by the counsel for the informant. Thereafter, supplementary affidavit has been filed by the petitioners that other cases are also pending against the petitioners.

No.7620 of 2019(6) dt.03-07-2019 2/2 It is mentioned in the supplementary affidavit that one more case is pending against petitioner No.1 vide Complaint Case No.1582 of 2018 and three other cases are pending against petitioner No.2 as mentioned in para 2 of the supplementary affidavit.

It is alleged that the Complainant/Informant is rightful owner of the land, in question, under Jamabandi No.398. On the order of Revenue Officer, his land is barricaded by the pillars. On 26.05.2018, co-accused persons dismantled the pillars with a view to extort money. Accused persons also obtained ownership certificate with regard to the land belonging to the Complainant /informant in collusion with Halka Karamchari. In view of such conduct of the petitioners, this Court is not inclined to enlarge the petitioners on bail. Prayer of the petitioners for grant of bail is rejected at this stage.

Liberty is given to the petitioners to renew their prayer for bail after completing one year in custody. (Sanjay Priya, J) J. Alam/- U T
