The petitioner seeks bail in a case registered under Sections 420, 379 of the Indian Penal Code.

The prosecution case in short is that having exchanged the ATM Card of the informant, the accused person withdrew Rs. 21,000/- from the account of informant.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 09-07-2018. Charge sheet has already been submitted. The petitioner has remained in custody for more than 9 months. The offence is triable by Magistrate. There is no other substantive evidence to suggest the implication of the petitioner in the present case.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Rahika P.S. Case No. 57 of 2018.
