====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-12-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Nalanda P.S. Case No. 68 of 2019, registered under Section 302/34 of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Nalanda at Biharsharif.

The accusation is that at about 10.30 A.M., on 16.05.2019, Shikandar Kumar, brother of the informant, Sanjay Singh, was accompanied by Bhagirath Raut, Ganpat Raut and Golden Raut from his house. After one hour, he proceeded to his maize field and when he reached at the road then saw that Vikki Raut and Mukesh Raut were present on E. Rickshaw and Gunjan Raut (petitioner) carrying his brother then he tried to stop the E. Rickshaw but E. Rickshaw proceeded towards east direction. In the meantime,

Patna High Court CR. MISC. No.79737 of 2019(2) dt.05-12-2019 2/2 brother of the informant fell down on the road from the E. Rickshaw, while he was rushed at the hospital but he was declared dead. Cause of occurrence is that on the occasion of marriage of daughter of accused, Bhagiraqth Raut, they had taken cash of Rs.2,00,000/- from Sikandar Kumar, brother of the informant, and after marriage, Sikandar Kumar, brother of the informant, demanded the money. Having regard to the facts and circumstances of the case and the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner, Gunjan Kumar @ Gunjan Raut, accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
