This application, for grant of anticipatory bail, arises out of Parash Bigha Police Station Case No. 116 of 2018, disclosing offences under Sections 304B/201/34 of the Indian Penal Code.
The petitioner no. 1 is mother-in-law and petitioner no. 2 is father-in-law of the deceased. Allegedly, there was demand of dowry. The deceased was married to the son of these petitioners three years back.
Learned Counsel for the petitioners has, however, drawn my attention to Annexure 2, an application filed by the
Patna High Court Cr.Misc. No.80188 of 2018(2) dt.16-01-2019 2/2 informant before the Court of learned Judicial Magistrate, Jehanabad, stating therein that the deceased had died as she was suffering from Diarrhea.
Considering that the petitioners are mother-in-law and father-in-law and that the allegation of demand of dowry of the accused persons is general, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri P.K. Bharti, Judicial Magistrate, 1st Class, Jehanabad in connection with Parash Bigha Police Station Case No. 116 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
