The instance application for regular bail has been filed by the petitioner in connection with Phulparash P.S. Case No. 185 of 2021 instituted for the offence u/s 147, 148, 149, 447, 323, 324, 325, 307, 302, 427 of the Indian Penal Code and Section 27 of the Arms Act.

Earlier, the application for bail of the petitioner was rejected by order dated 22.08.2023 passed in Cr. Misc. No. 24904 of 2023.

In pursuance to the direction of the Court, a Report with regard to present state of trial vide dt. 27.01.2024 has been received from which, it appears that record is fixed for

Patna High Court CR. MISC. No.6446 of 2024(3) dt.13-03-2024 2/2 prosecution evidence and the learned trial Court had sought nine months time to conclude the trial.

No fresh ground is made for reconsideration of the regular bail application of the petitioner. Accordingly, this application is rejected.

The bail application stands disposed of.

However, learned trial Court is directed to conclude the trial within stipulated period of time i.e. nine months which is mentioned in its report, on day to day basis, as the petitioner is languishing in judicial custody since 19.10.2022, failing which the petitioner may renew his prayer for bail application.
