2. The petitioner seeks bail in connection with Sikraul P.S. Case No. 107 of 2023 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

3. As per the prosecution case, 60.480 liters of illicit liquor has been recovered from co-accused Gajendra Kumar.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case the name of the petitioner has come only on the confession of the other co-accused Gajendra Kumar who said that he was going to handover the liquor to the petitioner.

5. It is also submitted by the learned counsel for the petitioner that the petitioner is in jail since 10.11.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts and the period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Court No. 2, Buxar in connection with Sikraul P.S. Case No. 107 of 2023.

9. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Sikraul Police Station on first Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U T
