The petitioner is languishing in custody since 13.08.2019 in a case registered for the offences punishable under Sections 324, 307 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case is that the petitioner caused firearm injury on left middle finger of the informant. It is submitted by learned counsel for the petitioner that for the alleged occurrence of 20.03.2019, the written report was submitted on 22.03.2019. The accusation of causing firearm injury to the informant has been found simple caused by hard and blunt substance. Though, the petitioner is accused in three other cases but the impugned order suggests that the petitioner is
Patna High Court CR. MISC. No.79227 of 2019(2) dt.04-12-2019 2/2 also accused in the murder case of the brother of the informant. Learned APP submits that the accusation is specific against the petitioner.
Considering the delayed lodging of the case and the fact that the accusation of causing firearm injury is not being corroborated by the medical opinion, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Udakishunganj, District - Madhepura in connection with Alamnagar (Ratwara O.P.)
