The present writ petition has been filed in the form of mandamus commanding the State respondent to issue rent receipt in favour of the petitioner with relation to lands bearing Khata No.54, Plot No.106, 107, 108, measuring an Area of 56 decimal falling within mauza Baluadi Kurd, P.S.-Kutumba, Block-Kutumba, Thana No.567 and further prayer of the

Patna High Court CWJC No.563 of 2025(2) dt.24-01-2025 2/2 petitioner herein-above is to command and direct the state respondents to get the aforesaid lands vacated from the clutch of the private respondents who have taken physical possession illegally by use of force and man power over the aforesaid lands.

3. Learned Counsel for the State submits that Circle Officer, Amba Kutumba, District- Aurangabad is competent to issue rent receipt in favour of the petitioner.

4. Learned Counsel for the petitioner submits that he has filed a representation before the Circle Officer, Amba Kutumba, District- Aurangabad (annexed as Annexure-1).

5. In light of the submissions made, this writ petition is hereby disposed off directing the petitioner to file a mutation case before the Circle Officer, Aurangabad within 30 days from today and upon receiving the said mutation case, the Circle Officer, Aurangabad after hearing all the concerned, shall pass order in accordance with law.
