The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Sikandra P.S. Case No. 225 of 2019, registered for the offence punishable under sections 341, 323, 307, 379 and 34 of the Indian Penal Code.

As per allegation made in the F.I.R., altercation is said to have taken place between the informant on one hand and the petitioner and his sons on other and the accused persons are said to have assaulted the informant.

It is submitted by learned counsel for the petitioner that altercation had taken place as a result of motorcycle of the petitioner dashing against the motorcycle of the informant. The allegations are general and omnibus in nature. The petitioner has

Patna High Court CR. MISC. No.82232 of 2019(2) dt.18-12-2019 2/2 no criminal antecedent and the case of petitioner stands on similar footing to that of his sons who have been granted bail vide order dated 08.11.2019 passed in Cr. Misc. No. 71540 of 2019.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the fact of grant of bail to co-accused, the Court is inclined to grant bail to the petitioner. The petitioner is directed to surrender in the Court below within a period of six weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Jamui in connection with Sikandra P.S. Case No. 225 of 2019, subject to the condition as laid down under section 438(2) of the Cr.P.C. (Partha Sarthy, J) sushma/- U T
