For the reasons stated in the application and affidavit, delay of 198 days in filing LPA is condoned. I.A. No.1 of 2019 stands allowed.

The present LPA is filed by the State of Bihar assailing the order of learned Single Judge dated 12.04.2019 passed in CWJC No. 4281 of 2018.

Learned counsel submitted that contesting respondents in CWJC No. 4281 of 2018 filed LPA No. 588 of 2019. Co-ordinate Bench dismissed the LPA No. 588 of 2019

Patna High Court L.P.A No.1582 of 2019(3) dt.09-02-2023 3/3 while affirming the order of the learned Single Judge dated 12.04.2019 passed in CWJC No. 4281 of 2018.

In the light of these facts and circumstances the appellants-State have not made out a case so as to interfere with the order of learned Single Judge.

Accordingly, the present Letters Patent Appeal No. 1582 of 2019 stands dismissed in the light of orders passed in LPA No. 588 of 2019.

Pending I.A, if any, stands disposed of.
