JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 This application, for grant of anticipatory bail, arises out of Marhaura P.S. Case No. 598 of 2019, disclosing offences under Sections 341, 323, 325, 324, 307, 506, 504/34 of the Indian Penal Code.

Prosecution case is that when the informant protested the sell of liquor by the petitioner, petitioner became angry and assaulted the informant causing injury to him. Submission of learned counsel for the petitioner is that he no criminal antecedent and has falsely been implicated in this case and there is no mentioning of weapon used by the petitioner to assault the informant and although there is allegation of assault, however, the injury sustained by the informant was found simple in nature, which will appear from annexure -2 of the petition.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chapra, Saran, in connection with Marhaura P.S. Case No. 598 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
