2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 118 ( 2 ), 109, 3(5) of BNS.
3 . The prosecution case in brief, is that on 17.09.2024 at about 3 . PM while informant was sleeping in his house , in the meantime , this petitioner who is the wife of informant came there and assaulted her with hammer on account of which informant sustained injury .
4. It is submitted on behalf of the petitioner that
Patna High Court CR. MISC. No.89046 of 2024(3) dt.15-04-2025 2/3 petitioner is wife of informant and has not committed any offence as alleged. Earlier petitioner has lodged case in Mahila ( Ranchi ) P S Case No. 01 of 2024 against informant and in retaliation this false and concocted case has been filed against petitioner. It is further submitted that on 03.01.2024 , a divorce case vide Original Matrimonial suit No. 14 of 2024 was also lodged by this petitioner before Family Court Ranchi but later the matter was compromised and the case was withdrawn . In spite of compromise in the aforesaid Matrimonial suit case , informant again started torturing this petitioner and being aggrieved, petitioner again filed divorce case vide case No. 506 of 2024 on 26.06.2024 . There is no injury report on record to substantiate the allegation against this petitioner. Petitioner is lady and claims clean antecedent.
5 . Learned counsel for the State opposed the bail petition .
6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM
