The petitioner seeks bail in Goreyakothi P.S. Case No. 128/2018, instituted for offences under Section(s) 307, 302/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is Gotani of informant. There is land dispute between the parties. Instant case has been lodged after delay of 134 days. It is alleged in the written report that on the date of occurrence this petitioner along with her husband assaulted the daughter of informant, namely, Pinki Kumari with iron rod and Tangi due to which she sustained injury and finally died in the hospital.

Learned counsel for the petitioner has submitted that

Patna High Court Cr.Misc. No.2201 of 2019(3) dt.07-02-2019 2/2 witnesses in different paragraphs of case diary have stated that daughter of informant had sustained injury while she was playing on trailer of the tractor. All of sudden tractor moved and she fell down and sustained injury.

Learned Addl. P.P. has submitted that charge-sheet has been submitted in this case under Section 304 of the Indian Penal Code.

Petitioner is in custody since 27.07.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Goreyakothi P.S. Case No. 128/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
