2. The petitioner seeks bail in connection with Ganga Bridge P.S. Case No. 35/2023 registered for the offence under Section 392 of the Indian Penal Code.
3. The prosecution case in nutshell is that the motorcycle, mobile phone and cash with some other documents of the informant was looted by three unknown miscreants while he was returning home.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he is not named in the FIR and his name has surfaced in the confessional statement of one Raju Chaudhary who has stated that the petitioner along
Patna High Court CR. MISC. No.89816 of 2024(4) dt.08-05-2025 2/3 with one Ankit @ Charlie are engrossed in the case of loot. It has further been submitted that the similarly situated coaccused namely Ankit @ Charlie @ Ankit Raj has been granted bail by a Co-ordinate Bench of this Court and the order of the same is annexed as Annexure 'P-2' to the petition. It has further been submitted that no TIP has been conducted till date. It has lastly been submitted that though the petitioner carries seven criminal antecedent, he has falsely been implicated in this case and he is in custody since 29.04.2023.
5. Learned counsel for the State has opposed the prayer for bail of the petitioner.
6. Considering the facts and circumstances of the case and also the submission made by the parties and taking into account that till date no TIP has been conducted and similarly situated co-accused namely Ankit @ Charlie @ Ankit Raj has been granted bail by a Co-ordinate Bench of this Court and the order of the same is annexed as Annexure 'P-2' to the petition, let the petitioner above-named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount
