====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-01-2025 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 191(2), 190, 126(2), 109(1), 352, 351(2) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.
3. As per prosecution case, on 23.09.2024 at about 3
Patna High Court CR. MISC. No.89637 of 2024(2) dt.29-01-2025 2/3 PM, while petitioner No. 1 and others had gone to put boundary over the Government land, in the meantime, all the F.I.R. named accused persons including these petitioners assaulted father of the informant as a result of which he sustained injury on right leg.
4. Learned counsel for the petitioners submits that on account of dispute over pathway, quarrel took place between the parties. Allegation of assault is general and omnibus and there is no allegation of specific overt act against these petitioners. There is no injury report on record to substantiate the allegations levelled against petitioners. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the backdrop of the case and other facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Bhojpur at Ara in connection with Chauri P. S. Case No. 115 of 2024, subject to condition as laid
