====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 24-02-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehend his arrest in connection with Sono P.S. Case No. 69 of 2024, registered for the offences punishable under Sections 341, 323, 308, 504, 506 and 34 of the Indian Penal Code.

3. The case of the prosecution, in brief, is that on 20.02.2024, the informant Chamcham Khatoon after disposing garbage was returning to her house, meanwhile the accused Bebi Khatoon, Md. Sabrej, Seema Khatoon and Rukshar Khatoon came and started abusing, however she silently returned to her home. Thereafter, on instigation of her Bhaisur namely Md. Karim all the four accused persons started assaulting her brutally and meanwhile her Bhaisur Md. Karim

Patna High Court CR. MISC. No.87570 of 2025(3) dt.24-02-2026 2/3 come with Tangi and gave the same to Md. Sabrej and asked him to kill her upon which Md. Sabrej assaulted on her head with Tangi due to which she became severely injured. Hearing the hue and cry her gotiya Tusiya @ Gosiya Khatoon came and somehow brought her to Sono Hospital for treatment. On the basis of above, FIR was lodged against the accused persons.

4. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent. It is next submitted that petitioner has been falsely implicated in the present case due to family related dispute. Learned counsel for the petitioner further submits that the allegations are general and omnibus in nature. It is further submitted that the injury report does not substantiate the prosecution version as alleged in the FIR.

5. Learned A.P.P. for the State opposes the prayer of anticipatory bail.

6. Considering the fact that there is a specific allegation against the petitioner of having assaulted the informant, Chamcham Khatoon on her head with Tangi due to which she got severely injured and further taking into account that the lady Chamcham Khatoon was pregnant at that point of time, the Court is not inclined to grant anticipatory bail to the petitioner despite the fact that the injury report shows simple
