JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Bakhtiyarpur P.S. Case No. 499 of 2018 for the offenses under Sections 147, 148, 149, 341, 323, 307, 427, 353, 283 IPC and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. In the instant case 29 persons have been made accused by the Choukidar and omnibus allegation has been levelled against all of them. The petitioner is in custody since 4.10.2018.

Considering the fact that omnibus allegation has been levelled against all the accused persons, the petitioner is in custody since 4.10.2018 and he has no criminal antecedent, let
