The petitioner seeks regular bail in connection with Excise case no. 328C2 of 2018 registered for the offence punishable under Section 30(a) of the Bihar Excise & Prohibition Act, 2016.
The allegation is regarding recovery of 401.01 liters of illicit liquor from a Tata 407 truck when the same was apprehended by the police and the petitioner was caught from the said truck.
The learned counsel for the petitioner submits that the petitioner is neither the owner of the said truck nor has anything to do with the illicit liquor seized by the police and
Patna High Court Cr.Misc. No.2091 of 2019(2) dt.17-01-2019 2/2 infact, the petitioner had merely taken lift in the said truck, hence the petitioner has got no complicity in the alleged crime. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 27.11.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Addl. District and Sessions Judge-II, Jamui in connection with Excise case no. 328C2 of 2018. (Mohit Kumar Shah, J) rinkee/- U T
