SONI SHRIVASTAVA ORAL ORDER 28-07-2025 Heard learned counsel for the petitioner, learned counsel for the Opposite Party No. 2 and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Complaint Case No. 186 of 2023 offences punishable under Sections 498(A), 323 and 494 of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

3. The case is under Section 498(A) and the petitioner is the husband. The matter had earlier been referred to the Patna High Court Mediation Centre but the mediation process had failed. However, this Court had granted time to the

Patna High Court CR. MISC. No.89496 of 2024(5) dt.28-07-2025 2/3 counsels for negotiating the matter so that a settlement can be reached between the parties. Today, it has been informed that an amount of Rs. 6 lakhs has been agreed upon between the parties, which would act as one time settlement for all litigations and grievances between the parties. It has been agreed that the payment of an amount of Rs. 6 lakhs would be made within a period of six months in installments.

In such view of the matter, I am inclined to grant the privilege of Provisional Bail to the petitioner upon making a payment of Rs. 2 lakhs as a first installment, a receipt of which would be shown at the time of furnishing of the bail bonds. Thereafter, the rest of the amount would be paid in installments within a total period of six months from the date of furnishing of the bail bonds. It goes without saying that after the entire payment of the amount of Rs. 6 lakhs is made by the petitioner, the Provisional Bail granted to the petitioner would be confirmed by the learned Court below.

5. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be enlarged on Provisional Bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two

No.89496 of 2024(5) dt.28-07-2025 3/3 sureties of the like amount each to the satisfaction of the learned S.D.J.M., Udakishunganj, Madhepura in connection with Complaint Case No. 186 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/482(2) of the B.N.S.S., 2023.

6. It goes without saying that in the intervening period of six months, the parties would take steps towards withdrawal of cases against each other.

7. The application stands disposed of with the above observation.
