2. The petitioners are in custody in a case registered for the offence punishable under Sections 33, 34 and 36 of the Bihar Prohibition and Excise Act, 2016.
3. As per allegation in the FIR, informant's father died
Patna High Court CR. MISC. No.7772 of 2025(5) dt.19-03-2025 2/3 after consuming spurious liquor which was purchased from unknown miscreants. Petitioners are not named in the FIR and their name comes from the confessional statement of other coaccused persons.
4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case He next submits that similarly situated co-accused persons have already been granted bail by a co-ordinate Bench of this Court as also this Court passed in Cr. Misc. Nos. 53398 of 2023, 55108 of 2023, 55958 of 2023, 57743 of 2023, 59691 of 2023, 60928 of 2023, 61298 of 2023, 61952 of 2023, 68976 of 2023, 5558 of 2024, 14053 of 2024 and 63339 of 2024. Petitioner is in custody since 22.08.2024
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. In view of the aforesaid facts as well as the fact that several other co-accused persons have been granted bail by a coordinate Bench of this Court, so let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge-I, Nawada in connection with Nawada (Nagar) P.S. Case
