JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bhagwan Bazar P.S. Case No. 330 of 2018 registered for the offence punishable under Section 364/34 of the Indian Penal Code.
Allegation against the petitioner is that he has abducted the son of the informant.
Submission of learned counsel for the petitioner is that, as a matter of fact, son of the informant has eloped with the wife of the petitioner and for that petitioner has lodged a case at Bangalore, which will appear from paragraph-33 of the case diary with respect to abduction of his wife, and the present case has been filed in order to save his skin.

Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.80240 of 2018(4) dt.20-02-2019 2/2 circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran, in connection with Bhagwan Bazar P.S. Case No. 330 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
