Learned counsel appearing on behalf of the petitioner submits that in view of the stand taken in para-8 of the counter affidavit the writ petition may be disposed of. It is submitted that the respondents agreed to pay the dues on receipt of the certified copy of the judgment in criminal case which was decided in favour of the petitioner. Mr. Vinay Kirti Singh, learned senior counsel appearing on behalf of the Bihar State Power Holding Corporation with reference to para-14 of the counter affidavit

Patna High Court CWJC No.24648 of 2019(4) dt.31-08-2020 2/2 submits that gratuity has been paid to the petitioner. He submits that the Bihar State Power Holding Corporation will examine the judgment and will act accordingly.

Considering the stand of the parties, the writ petition is disposed of with a direction to the Bihar State Power Holding Corporation to pay the admissible terminal dues to the petitioner, if the petitioner produces certified copy of the judgment of the acquittal alongwith a copy of this order at the earliest, preferably within a period of four months from the date of filing of certified copy of the judgment of the trial court.
