JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-03-2019 This is an application for grant of anticipatory bail in connection with Pakaridyal P.S. Case No. 176 of 2018, disclosing offences under Sections 366(A), 363/34 of the Indian Penal Code.

Allegation against the petitioners is of kidnapping the minor daughter of the informant.

Submission of learned counsel for the petitioners is that now the girl has been recovered and she has denied the prosecution case and also stated that she has married with one Raj Kumar Yadav, who is brother of petitioner nos.1 & 2, son of

No.3145 of 2019(3) dt.11-03-2019 2/2 petitioner no.3, petitioner nos.4 & 5 are also relative and petitioner nos.6 & 7 are the family friends of other petitioners and it has also been submitted that the compromise petition has also been filed. Further, they have no criminal antecedents. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances of the case, this application is disposed of with a direction to the petitioners to surrender before the learned court below within a period of six weeks and pray for regular bail, which will be considered by the learned court below on the basis of statement of the victim girl as well as submission that the compromise has been made between the parties, considering the same, the learned court below shall pass an appropriate order, if possible, to be disposed of on the same day.
