2. The petitioner seeks bail in a case registered for the offences punishable under Sections 103(1) and 3(5) of the B.N.S., 2023.

3. As per the prosecution case, the informant, Md. Masihullah, alleged that on 25.07.2025, after a marriage ceremony in his village Mahapatia, miscreants opened fire. His son, Md. Iftekhar @ Lala, was hit on the head by a bullet fired by Md. Sharif and died within 10 minutes. The firing involved 9-10 people, including the petitioner and four others identified by the informant.

4. Learned counsel for the petitioner submits that the specific accusation is against Md. Sharif, who shot the son of

Patna High Court CR. MISC. No.85240 of 2025(2) dt.09-12-2025 2/2 the informant in the head. There is no specific allegation of assault against this petitioner. This petitioner is in custody since 27.07.2025, and the charge-sheet has been submitted in this case.

5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the nature of the accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.

Accordingly, let the above-named petitioner be released on bail on furnishing a bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.M.-II, Jhanjharpur, Madhubani, in connection with Bheja P.S.
