JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-03-2019 The petitioners apprehend their arrest in connection with Aungari P.S.Case No. 49 of 2018 registered under Sections 307, 323, 325, 341, 504 and 506/34 of the Indian penal Code. Allegation against the petitioner no. 2 is of assaulting by lathi and against petitioner no. 1 and others is of assault and it further appears that he is an accused in one more case. Submission of learned counsel for the petitioners is that injury on the person of the informant is simple in nature and injury on person of the father of the informant is kept reserved. Heard learned APP and learned counsel appearing on behalf of the informant. They have opposed the prayer for anticipatory bail on the ground that petitioners are accused in one more case which they have suppressed.

Having heard both sides and in view of the facts and

No.3973 of 2019(3) dt.08-03-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to them rather they should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order, if possible, on the same day.
