2. Learned counsel for the petitioner has stated that the petitioner has already approached the Divisional Commissioner way back in the year 2020 but till date the same has not been disposed off.

3. Without going into the merits or demerits of the case, having regard to the amendment issued by notification dated 21.07.2022 to the Bihar Authority and Public Distribution System Control, IInd Amendment Order - 2022 and also the fact that the petitioner has already approached

Patna High Court CWJC No.226 of 2019(3) dt.30-01-2024 2/3 the Divisional Commissioner, the present writ petition is disposed off with a direction to the Divisional Commissioner to verify if the petitioner has filed a petition ventilating his grievance and the said application is still pending. In case the same is found to be true, the Divisional Commissioner shall dispose off the same in accordance with law duly putting all the parties on notice and then passing a reasoned order.

4. The entire exercise shall be completed within a period of four weeks from the date of the receipt of the copy of this order.

5. It is needless to mention that before passing any order, the Divisional Commissioner shall give an opportunity of hearing to the parties. Any order passed, shall be communicated to the parties. In case the Divisional Commissioner finds that no such application is found or is pending then he shall intimate the said fact to the petitioner. If a communication is received from the Divisional Commissioner that the file is not traceable or not found, then liberty is granted to the petitioner to file afresh application before the Divisional Commissioner within a
