2. The petitioner seeks regular bail in registered for the offences punishable under sections 341 , 323 , 324, 307, 379, 504, 506 and 34 of the Indian Penal Code . 3 As per the prosecution case , this petitioner is alleged to have assaulted the wife of the informant by means of Dabia as a result of which during course of treatment the deceased died.
4. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case due to personal gudge and local politics. Though, there is allegation of assault against this petitioner but none of the witnesses have supported the prosecution case . Petitioner is in custody since 08.08.2023 .

No.162 of 2024(3) dt.21-03-2024 2/2 5 However, learned counsel for the State opposes the prayer for bail and submits that there is specific allegation against this petitioner that he assaulted the deceased by means of dabia due to which she died. From perusal of the case diary, it is apparent that witnesses have supported the prosecution case and post-mortem report also supports the prosecution case . 6 Considering the nature of accusation and materials available on the records against the petitioner, his prayer for bail is refused.
