The petitioner has prayed for bail in connection with Bettiah Town P.S. Case No. 529 of 2019 registered for the offence punishable under sections 414 and 34 of the Indian Penal Code and section 25(1-b)a/26/35 of the Arms Act. As per allegation in the FIR, three accused persons including the petitioner herein were caught while checking of vehicles were going on by the police. It is stated that a loaded country made pistol was recovered from possession of coaccused Md. Saud. It is submitted by learned counsel for the petitioner that the allegations in the FIR are false and concocted. He is

Admittedly no recovery of any incriminating article has taken place from his possession and he is in custody since 18.07.2019. It is further submitted that after lodging of the instant case, he has been remanded in one another case which was initially registered against unknown. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town P.S.
