The petitioner seeks regular bail in connection with Rajgeer PS case no. 163 of 2019 instituted for the offence punishable under Section 392 of Indian Penal Code. The allegation is regarding unknown miscreants having looted a sum of Rs. 90,000/- from the informant after intercepting him.
The learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that after the co-accused person namely Pintu Kumar was arrested by the police, he disclosed the name of the petitioner to be one of his accomplice. It is further submitted that neither any T.I. parade
Patna High Court CR. MISC. No.79282 of 2019(2) dt.14-01-2020 2/2 has taken place so as to connect the petitioner with the alleged crime nor any looted cash has been recovered from the possession of the petitioner and the petitioner is languishing in custody since 18.07.2019. Lastly, it is submitted that the co-accused persons including the aforesaid Pintu Kumar have already been granted bail by a co-ordinate Bench of this Court vide order dated 04.12.2019 passed in Cr. Misc. no. 79024 of 2019.
Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also taking into account the fact that the case of the petitioner is better than that of the co-accused persons who have already been granted bail by a co-ordinate Bench of this Court, I deem it fit and appropriate to release the abovenamed petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rajgeer PS case no. 163 of 2019.
