The petitioner seeks bail in anticipation of his arrest in connection with Samastipur P.S. Case No. 6 of 2018 dated 27.02.2018 instituted for the offences under Sections 354, 420, 406 and 34 of the Indian Penal Code.

The petitioner is alleged to have promised the informant of marrying her but later resiled from the aforesaid promise as no dowry was paid to him. Later, it has been alleged, on the asking of the petitioner, the informant paid Rs. 20,000/- to the petitioner but despite that, the father of the informant was insulted and thrown out of the house when he had gone to negotiate the marriage of his daughter/informant with the

Learned counsel appearing for the petitioner submits that the story propounded in the FIR, on face of it, does not appear to be correct. There is no reason why the informant should have accepted the proposal of the petitioner for giving him Rs. 20,000/- for the purposes of marriage when earlier a bigger amount was demanded by way of dowry.

Regard being had to the nature of accusatiion in the FIR, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-2, Samastipur in connection with Samastipur P.S. Case No. 6 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
