2. Earlier the case of the petitioner was rejected on 30.08.2023 in Cr. Misc. No. 35725 of 2023.

3. This is repeat petition in which the Trial Court Report was called for and according to it, two of out of five witnesses have been examined and the next date for hearing is 03.05.2025.

4. The allegation against the petitioner is that he took his own child outside home and later threw in the "Koshi" river. The case of the prosecution is that he doubted that the boy has not come in this world out of their wedlock and this led to the unfortunate end of the seven years old child.

5. The allegation against the petitioner is heinous and

Patna High Court CR. MISC. No.1869 of 2025(3) dt.01-05-2025 2/2 in that background, earlier the bail application of the petitioner was rejected directing the Trial Court to expedite the trial and take the same to its logical conclusion in one year.

6. The same has not been concluded. However, considering the allegation that has come against the petitioner, for the present, this Court is not inclined to extend him the privilege of bail which is accordingly rejected.

7. The Trial Court should speed up the matter and see to it that the trial is concluded in six months and special effort should be taken to issue bailable/non-bailable warrant directing the S.P./Officer-in-Charge/Investigating Officer to ensure presence of the witnesses on each and every date.
