The petitioner seeks bail in Town P.S. Case No.160 of 2019, registered under Sections 454 and 380 of the Indian Penal Code.
The informant disclosed that while he was going to Delhi on a train and when he reached near Samastipur, he got information that theft was committed in his house. He got down from the train and came to his residence. The informant disclosed that ornaments, house hold articles etc. were stolen away.
Learned counsel for the petitioner submits that the petitioner is innocent and he has infact committed no offence. The petitioner is not named in the FIR. The name of the
Patna High Court CR. MISC. No.79820 of 2019(2) dt.05-12-2019 2/2 petitioner surfaced in the case in the confessional statement of a co-accused, Govind Ram. Save and except the confessional statement of Govind Ram in para 44 of the case diary, there is no other tangible material to show the involvement of the petitioner. No stolen article has been recovered from possession of the petitioner. The petitioner has of course got criminal antecedents but the petitioner is in jail since 20.07.2019. Taking into consideration the facts that save and except the confessional statement, there appears no tangible material against the petitioner and the petitioner has already remained in jail for more than four months, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhubani in connection with Town P.S.
