2. Petitioner seeks pre-arrest bail in connection with Mahila P.S.Case No.39 of 2022 registered for the offences punishable under Sections 341, 323, 498(A), 354(B), 379, 504 & 506/34 of the Indian Penal Code.
3. The present case relates to matrimonial dispute between the petitioner and Opposite Party No.2, who are husband and wife respectively. The allegation against the petitioner is of torturing the opposite party no.2.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.8898 of 2024(2) dt.20-02-2024 2/3 petitioner submitted that the petitioner is ready to live along with O.P.No.2 and he will fulfil her all the financial as well as physical desire and also he will keep her with full care and respect.
5. Learned APP for the State has submitted that the matrimonial dispute shall be resolved amicably within the parties.
6. Considering the aforesaid submissions made on behalf of the petitioner, the petitioner, if so desire, may file an affidavit before the district court specifically stating therein that he is ready to live along with O.P.no.2 and he will fulfil her physical and financial requirement and will keep her with full dignity and honour. If such affidavit is filed by the petitioner, the petitioner is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Gaya/concerned court in connection with Mahila P.S.Case No.39 of 2022, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
7. The parties may also resolve their matrimonial
Patna High Court CR. MISC. No.8898 of 2024(2) dt.20-02-2024 3/3 dispute in an amicable manner. If required, they may file an application before the learned district court for referring the matter to the concerned District Mediation Centre.
8. With the above observation/direction, the present bail application stands disposed of.
