JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2019 Petitioners apprehend their arrest in connection with Katihar Town P.S. Case No. 548 of 2018 registered for the offences punishable under Sections 420, 406, 504, 323, 385 and 120B/34 of the Indian Penal Code.

Prosecution case is that the informant was married with one Pappu Sah and allegation is that there was illicit relationship with Pappu Sah and her younger sister and further allegation is that accused persons have taken case cash and jewellery worth Rs.10,000/- and informant was threatened with respect to execution of sale deed of her house. Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and as a

Having heard both sides and in the facts and circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar, in connection with Katihar Town P.S. Case No. 548 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
