JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-03-2019 This is an application for grant of anticipatory bail in connection with Deepnagar P.S. Case No. 33 of 2011, disclosing offences under Sections 392 of the Indian Penal Code. Allegation as per F.I.R. is that is of forcibly taken a tank lorry bearing registration no. BR 9B- 9335. Petitioner is not named in the F.I.R, later on his name transpired on the basis of confessional statement. It further appears that the petitioner is accused in two other cases.

Submission of learned counsel for the petitioner is that the petitioner is aged about 70 years and there is nothing against him except confessional statement.

Having heard both sides, in view of the facts and circumstances of the case, this application is disposed of with a

Patna High Court CR. MISC. No.891 of 2019(5) dt.07-03-2019 2/2 direction to the petitioner to surrender before the court below and make prayer for regular bail, which shall be considered on the basis of materials available on record and also considering the age of the petitioner, if possible, to be disposed of on the same day.
