The petitioners seek pre-arrest bail in connection with Nawada (Kadirganj) P.S. Case No. 771 of 2019, registered under Sections 147, 149, 341, 323, 308, 379, 504, 506, 354(b) of the Indian Penal Code.

The accusation is that in the morning of 23.06.2019, eight persons, named in the first information report, including the petitioners, variously armed with weapons, came at the door of the informant, Sanoj Singh, and started to abuse. At that time, Raj Kumar Mahto (petitioner no. 2) gave a sword blow, but, the same was caught hold by the informant in which he sustained blood oozing injury in his hand, thereafter, Shyam Sundar Mahto (petitioner no. 1) gave iron rod blow to the informant and other family members were also assaulted by the

Submission is that occurrence of marpeet took place due to land dispute while specific allegation has been made against petitioner no. 2 of giving sword blow at the hand of the informant, but, only one lacerated wound is found at the index finger of the informant, which is said to be grievous in nature. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Nawada (Kadirganj) P.S. Case No. 771 of 2019 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
