JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Vishnupad P.S. Case No. 262 of 2018, registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 750 ml. of liquor from the house of one co-accused, who disclosed the name of the petitioner and it further appears that petitioner is accused in one more case of similar nature.

Submission of learned counsel for the petitioner is that he has been made accused on the basis of confessional statement of co-accused and earlier also he has been made accused on the basis of confessional statement and he is ion bail in that case.

Heard learned APP also.

No.9965 of 2019(3) dt.25-04-2019 2/2 Having heard both sides and in the facts and circumstances, let petitioner, above named, surrender within a period of six weeks from the receipt of this order and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Gaya, in connection with Vishnupad P.S.Case No. 262 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that if his active involvement is found in similar type of case in future, the prosecution is given liberty to move for cancellation of his bail bonds.

Let a copy of this order be communicated to the Sr. Superintendent of Police, Gaya.
