The petitioner seeks bail in Raghunathpur P.S.Case No.142/18 registered under Sections 272, 273, 308 of the I.P.C. and Sections 30(a)/38(a)/41(1) of the Bihar Prohibition and Excise Act.

The allegation is of recovery of 279 litres of foreign liquor kept in a bag on the bicycle of the petitioner and others.It is further alleged that on seeing the police party the petitioner along with other co-accused persons fled away leaving his bag and bicycle.

It has been submitted on behalf of the petitioner that recovery of the liquor has been affected from the abandoned place and the petitioner has not been arrested from the place of occurrence and he is in custody since 5.11.2018.

No.80382 of 2018(3) dt.13-03-2019 2/2 Considering the fact that the petitioner is accused in a case of similar nature previously, I am not inclined to grant bail to the petitioner. The prayer for bail of the petitioner is rejected. However, petitioner will be at liberty to renew his prayer for bail after completing six months in custody.
