The petitioners are apprehending their arrest in a case registered under Sections 406, 420, 120(B) and 34 of the Bihar Prohibition and Excise Act, 2016.

The prosecution allegation, in short, is that on false assurance, the accused persons cheated the informant and has not sanctioned the loan.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the

Patna High Court CR. MISC. No.81980 of 2019(2) dt.18-12-2019 2/2 present case. There is no documentary evidence to show that any amount was deposited to the petitioners. No wrongful gain or wrongful loss has been made on the part of the petitioners. On behalf of the State, it is submitted that the petitioners are named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Barari P.S. Case No. 301 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
