The petitioner seeks bail in a case registered under Sections 147, 148, 149, 384, 386 of the Indian Penal Code and 17 of C.L.A. Act.
Allegedly, in the night of 07-08-2010, 25-30 miscreants having armed with weapons reached at his brick-kiln and demanded levy through letter in the name of Maoist. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 15-05-2018. Charge sheet has already been submitted. There is no other substantive evidence to suggest the implication of the petitioner in the present case. There is no recovery of any incriminating article
Patna High Court CR. MISC. No.6127 of 2019(4) dt.17-07-2019 2/2 from possession of the petitioner. Petitioner is not named in the FIR. His name transpired in this case in course of investigation. On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Karja P.S. Case No. 125 of 2010.
