2. The petitioner is apprehending arrest in connection with Madhwapur P.S. Case No. 01 of 2022 registered on 04.01.2022 under Sections 341, 323, 447, 324, 354(A), 308, 379, 504, 506/34 of the I.P.C. pending before Judicial Magistrate, Ist Class, Benipatti, Madhubani

3. As per the prosecution case, F.I.R. has been lodged against four named accused persons including the petitioner against whom there is an allegation that they have surrounded the informant when he was returning to his house and it has been alleged that Anurag and Abhiram Thakur both attacked on the informant's side due to which they injured.

4. Counsel further submits that petitioner is innocent

Patna High Court CR. MISC. No.969 of 2024(3) dt.19-04-2024 2/2 and has committed no offence. He further submits that petitioner having no criminal case pending against him. He further submits that petitioner is not criminal rather dispute has arisen by virtue of theft of cow dung in the village

5. Learned counsel for the State opposes the prayer for bail and submits that there is allegation against the petitioner that he has assaulted the informant.

6. As such, considering the aforesaid facts and circumstances, this Court is not inclined to enlarge the petitioner on bail. Accordingly, the anticipatory bail application of the petitioner is hereby rejected.
