SONI SHRIVASTAVA ORAL ORDER 25-02-2026 Heard learned counsel for the petitioner, learned APP for the State and learned counsel appearing for the informant.

2. The petitioner seeks bail in a case registered for the offence punishable under Sections 140 (3) and 96 of B.N.S.

3. As per the prosecution case, the minor daughter of the informant did not return from the school.

4. Learned counsel for the petitioner submits that the present case arises out of a love relationship between the petitioner and the victim girl and upon her recovery her statement has been recorded under Section 183 of the B.N.S.S wherein she has admitted the fact that she had called the petitioner and went with him to Ludhiana where she was staying along with him while the police

Patna High Court CR. MISC. No.87051 of 2025(3) dt.25-02-2026 2/2 apprehended both of them and brought them to Hajipur. She has completely negated the factum of kidnapping and has further submitted that she has also performed marriage with the petitioner. Further, she has also refused her medical examination which would be evident from paragraph 54 of the case diary. Petitioner is also a young boy aged about twenty one years having no criminal antecedent. Petitioner is in custody since 31.07.2025.

5. Learned APP for the State and learned counsel for the informant have also been heard.

Taking into consideration the facts and circumstances of the case and also considering the possibility of a love affair and the statement of the victim under Section 183 of the B.N.S.S , the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Hajipur Town P.S. Case No. 599 of 2025.
