2. The petitioner is apprehending his arrest in connection with Ramkrishna Nagar P.S. Case No. 598 of 2025 for the offence under Sections 309(5), 317(4), 336(3), 338 and 340(2) of the BNS and Section 25(1-b)a, 26 and 35 of Arms Act.

As per the prosecution story, the informant has alleged that on 19.07.2025 at about 10:06 hours, the STF Bihar, Patna informed Ramakrishnanagar Police Station that one Sonu Kumar was planning to commit a robbery. Acting on this information, a police team along with STF conducted a joint operation and apprehended Sonu Kumar near Gravity Mall, Kankarbagh. During interrogation, Sonu disclosed the involvement of Abhishek Kumar, who had provided information
Patna High Court CR. MISC. No.85719 of 2025(2) dt.24-12-2025 2/3 about a person regularly carrying a large amount of cash for bank deposits. Abhishek Kumar was subsequently arrested. Sonu Kumar also disclosed the name of Vinay Kumar (petitioner) who is alleged to carry a weapon earlier possessed by him. Further, interrogation revealed the involvement of Vishal Kumar a habitual offender. Vishal Kumar was apprehended near Jaganpura petrol pump with a Pulsar motorcycle. On his disclosure, a country-made pistol and two live cartridges were recovered from his cowshed on 20.07.2025.

Learned counsel for the petitioner submits that the petitioner is quite innocent and has committed no offence rather he has falsely been implicated in this case on account of dirty village politics. The prosecution story is out and out false and concocted and there is no iota of truth at all in the facts and circumstances of the case. From perusal of F.I.R., it appears that the informant stated that on information received by the STF Bihar he has arrested one accused namely, Sonu Kumar who has disclosed that the he was keeping a weapon but presently it is taken by the petitioner who is now at Deoghar, meaning thereby there is no role of the petitioner in the alleged crime, his name has surfaced in this case only on the basis of statement given by the co-accused while he was in custody of the police. Learned counsel further submits that nothing has been recovered from the
Patna High Court CR. MISC. No.85719 of 2025(2) dt.24-12-2025 3/3 possession of the petitioner and apart from the confessional statement of Sonu Kumar nothing has come against this petitioner. As per para 3 of this bail petition, petitioner has clean antecedent.
5. Learned APP opposes the prayer for bail.
6. Keeping in view the aforesaid facts, and considering the clean antecedent of the petitioner, this Court is inclined to extend him the privilege of anticipatory bail.
7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the date of receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate 1st Class-15, Patna, in connection with Ramkrishna Nagar P.S. Case No. 598 of 2025 subject to the conditions as laid down under Section 482 of B.N.S.S., as also with the condition that one of the bailors should be close relative of the petitioner.
