The petitioner seeks bail in anticipation of his arrest in connection with Guthni P. S. Case No. 150 of 2018 dated 22.06.2018 instituted for the offences under Sections 413, 414 and 34 of the Indian Penal Code and Section 25(1-b), a, 26/35 of the Arms Act.

It appears that one Vikky Madhesiya was arrested by the policy party and from his possession arms and ammunitions were recovered. The aforesaid arrested accused person is said to have named the petitioner as well as one

Patna High Court Cr.Misc. No.6150 of 2019(2) dt.04-02-2019 2/3 Brajesh Yadav who are stated to have run away when the policy party had arrived.

Learned counsel for the petitioner has submitted that apart from the confession referred-to-above, there is no other material to connect the petitioner with the offence. Earlier, the petitioner was made accused in a case instituted under Section 307 of the I.P.C. at the instance of one of his agnates, in which case the petitioner is on bail. The other case in which the petitioner has been made accused under Section 384 of the I.P.C., has been lodged after the institution of the present case and in which case also he is on bail.

Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IIIrd, Siwan in connection with Guthni P. S.
