The petitioners are apprehending their arrest in a case registered under Sections 341, 364, 365/34, 120(B) of the Indian Penal Code.

Allegation is that the accused persons including the petitioners kidnapped the son of the informant. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. The informant is the father-in-law of petitioner

Patna High Court Cr.Misc. No.5550 of 2019(2) dt.31-01-2019 2/2 No.3 (Babita Devi @ Babita Kumari). Prior to institution of the present case, Babita Devi @ Babita Kumari had instituted a case against her husband and in-laws before the Mahila Thana, Gopalganj. Petitioner Nos.1 and 2 are the parents of petitioner No.3. The present case has been instituted only to put pressure upon the petitioners in respect of the case instituted by petitioner No.3.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.S. case No.309 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
