The petitioner seeks bail in a case registered under Section 304B/34 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner caused death of the sister of the informant due to nonfulfilment of demand of dowry. The earlier bail application of the petitioner was rejected taking into account that the petitioner is the husband of the deceased.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.05.2015 and has got no criminal antecedent. The petitioner has remained in custody for three years and ten months. Seven years is the minimum

Patna High Court CR. MISC. No.80516 of 2018(3) dt.13-03-2019 2/2 sentence. He has served for more than half period of sentence. A report was called for from the Trial Court. The Trial Court has reported that the charge has been framed and there is no chance of trial being concluded in near future. On behalf of the State, it is submitted that the petitioner is named in the complaint case.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge, Vaishali at Hajipur in connection with Bidupur P.S. case No.76 of 2014 (S.T.
