2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 409 and 420 of the Indian Penal Code and Section 7 of the E C Act.

3 . As per the prosecution case, the informant, namely Ram Vilas Singh, alleged that on 01.04.2015, five trucks laden with approximately five tonnes of rice each were dispatched; however, one such vehicle failed to reach its designated destination. It is further alleged that twenty-eight sacks of rice were unlawfully removed and stolen from the said vehicle and thereafter, the consignment of rice was being illicitly siphoned off and misappropriated from the truck while it was in transit

4. Learned counsel for the petitioner submits that petitioner is not PDS dealer. He is simply owner of truck in question and has got no concern with the rice which was stolen . Petitioner claims clean antecedent. 5 . Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above , be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM Barh in connection with Pandarak P.S. case No. 45 of 2015, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
